User Agreement

1. Introduction

This User Agreement ("Agreement") governs your access to and use of VideoCap ("Service"), an AI-powered video generation and editing application. By creating an account or using the Service, you agree to be bound by this Agreement.

2. Eligibility & Accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Use of the Service

• Do not use the Service to generate or distribute unlawful, harmful, misleading, hateful, harassing, or infringing content.
• Do not attempt to reverse engineer, abuse rate limits, or interfere with system integrity.
• Respect the rights of others, including privacy, publicity, and intellectual property rights.

4. Content Ownership & Licenses

You retain ownership of your inputs, prompts, uploaded media, and the outputs generated by the Service, subject to the rights of any third parties embedded in your inputs (e.g., music, images, logos). You grant the Service a non-exclusive license to process your content for the purpose of providing the Service, improving safety, and complying with law.

You are solely responsible for securing necessary licenses for any third-party assets used within your projects.

5. AI-Generated Content

Outputs may be probabilistic and not always accurate. Do not rely on outputs for legal, medical, financial, or other professional advice. You must review outputs before publishing and ensure they comply with applicable laws and platform policies.

6. Prohibited Uses

• Deepfakes of real persons without consent.
• Violent, sexual, or exploitative content involving minors.
• Malware, spam, scams, or deceptive practices.
• Infringing use of trademarks, copyrighted works, or protected likenesses.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and share information. Please review the Privacy Policy carefully.

8. Fees & Subscriptions

Certain features may require payment or a subscription. Fees are disclosed at the time of purchase. Except where required by law, payments are non-refundable. We may change pricing with prior notice.

9. Termination

We may suspend or terminate access for violations of this Agreement or to protect the Service and its users. You may stop using the Service at any time. Upon termination, certain provisions that, by their nature, should survive will remain in effect.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted operation, accuracy of outputs, or fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, or lost profits arising from or related to your use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless VideoCap and its affiliates from any claims, damages, liabilities, costs, and expenses arising out of or related to your use of the Service or violation of this Agreement.

13. Changes to this Agreement

We may update this Agreement from time to time. We will provide notice of material changes by updating the date above and, where appropriate, through in-app notices.
